The Naval Air Systems Command intends to negotiate and award a sole source Basic Ordering Agreement (BOA) order to Orbital Alliant Techsystems (OA), Plymouth, MN for the procurement of FMU-139D/B(D-2) Dummy Load Trainer Fuzes, FMU-139D/B(D-5) Dummy Load Trainer Fuzes, accessory sets, and replaceable parts for the FMU-139D/B Bomb Fuze Program. It is anticipated the resultant order will be firm fixed price. This requirement will be procured in accordance with the statutory authority permitting other than full and open competition under 10 U.S.C. 2304(c)(1), as implemented by the Federal Acquisition Regulation (FAR) 6.302-1, in that OA is the only responsible source and no other type of equipment will satisfy the agency requirements. OA is the designer, developer and sole producer of the FMU-139D/B Fuzes for the FMU-139D/B Bomb Fuze Program and the only company that possesses the data, technical skills and requisite knowledge of the design, fabrication, performance and operation to fulfill this need in a timely manner.
