The purpose of this amendment is to incorporate or remove the following (A, B, & C) from the solicitation # SPRAL1-12-R-0023 since Lockheed Martin (sole source) proposed FOB origin with inspection/acceptance at origin.

A) The Inspection/Acceptance and FOB Point under CLIN 0001 is hereby incorporate to read as follows:

INSPECTION POINT: ORGIN
ACCEPTANCE POINT: ORIGIN
FOB POINT: ORIGIN

NOTE: Remove all references to provisions; 52.246-9007 "Inspection and acceptance at destination" and 52.247-34 "FOB Destination". Pages # 3, 5, and 6.

Note: Remove all reference to provision # 52.213-9001 "Evaluation factors for source inspection".

B) Supplies and Packaging address is hereby incorporate:

INCORPORATE all reference to provision/clause # 52.246-9008: "Local Guidance: Use DLAD guidance unless procuring FMS. Used in all FMS orders regardless of PIC code. Paragraph (e) 1 of clause provides inspection requirements". "DLAD 46.503: Use as needed to indicate origin inspection and acceptance points in solicitations and contracts for supplies".

C) The following clauses will be incorporate in the solicitation/contract:
Provision # 52.247-29 F.O.B. - ORIGIN

Use in solicitations and awards when requesting F.O.B. Origin. It is Land and Maritime policy to obtain quotes on a F.O.B. destination basis for procurements below the simplified acquisition threshold whenever possible unless there are valid reasons to the contrary (e.g., sole source refusal). In determining whether offers are to be invited on f.o.b. origin or destination basis, or both, the primary consideration will be the selection of that delivery basis which will be most advantageous to the Government.
a. Solicitations generally will be on f.o.b. origin basis - (1) When overseas consignees above parcel post except for valid reasons (e.g., vendor's pricing policy includes cost of transportation to first CONUS destination). In this case, both the address applicable for parcel post shipments (FPO/APO) and the freight shipping address will be furnished in the order. (2) When destinations are tentative, (2) When diversions are anticipated, (3) When supplies are to move by premium transportation (IPD 01 through 03), or (4) When consolidation of small shipments can be made, (5) When weights are from 1 -150 lbs., IPD 01 - 08, a special low rate from FEDEX contract Worldwide Express (WWX) may be obtained and shipped direct overseas to the customer. b. Solicitations generally will be on an f.o.b. destination basis - (1) When CONUS consignees (including consolidation points) except for valid reasons as cited above. (2) When overseas consignees (FPO/APO) if item is within parcel post limitations (generally shipments of less than 70 pounds). In this case, vendor must be queried as to whether the parcel post limitations can be complied with. (3) When administrative delay and costs in evaluating origin offers would outweigh the potential advantage of a f.o.b. origin delivery basis. This is a matter of judgment to be based on circumstances of the individual acquisition as further outlined: (i) The obtaining of rates and computation of transportation costs for the evaluation of f.o.b. origin offers involves administrative costs and delays. Generally, for large purchases, 2 - 3 days are required to secure such data. This entails documentation on the part of the contracting officer, the DDC's transportation office, and MTMC; also, the cost of issuing and administering GBLs must be considered. For simplified acquisitions, transportation costs are given verbally, either by phone or email - no documentation needed, the same day. (ii) On the other hand, inviting offers on both a f.o.b. origin and f.o.b. destination basis may frequently result in savings in transportation costs. Such potential savings may be estimated based on past experience or informal advice. Buyers should consider special low rates available from FEDEX contract Worldwide Express (WWX) on f.o.b. origin basis only (see paragraph a 4 above) before awarding high priorities on a f.o.b. destination. (iii) All aspects should be considered including such factors as urgency of the acquisition; whether anticipated shipments clearly qualify for carload/truckload; in the case of multiple destinations, whether just one or several qualify for carload/truckload shipment, etc.
c. When export shipments are involved, solicitation will include M47C01, 52.247-9001,
PORT HANDLING AND OCEAN COSTS IN OFFER EVALUATION, which must be completed in accordance with guidance for the use of that provision.

DLAD 46.503-90(b)(1) - Use this clause in solicitations and awards with F.O.B. origin delivery terms where Government quality assurance will occur at one or more locations other than the prime contractor's location.

Provision# 52.247-1 COMMERCIAL BILL OF LADING NOTATIONS
FAR 47.107-4 - The contracting officer, in order to ensure the application of section 10721 rates, shall insert in solicitations and contracts when the contracts will be --
(a) Fixed-price f.o.b. origin contracts (other than contracts at or below the simplified acquisition threshold) (see 47.104-2(b) and 47.104-3).
(b) The contracting officer may insert in solicitations and contracts made at or below the simplified acquisition threshold when it is contemplated that the delivery terms will be f.o.b. origin.
