The Oregon Department of Fish & Wildlife is currently Requesting Quotes for the purchase and delivery of 46 tons of 20(N)-5(P)-15(K)-7(S) Fertilizer, delivered in bulk bins with power augers to: Jewell Meadows Wildlife Area 79878 Hwy 202 SEASIDE OR 97138. Must be able to deliver between October 12 and October 31, 2020 with a minimum of 3 days' notice. Multiple deliveries of up to 20 tons each may be requested. Must be able to leave bulk bins on site for up to 72 hours for offloading. Power augers must be in good working condition and be supplied with enough fuel to offload entire delivery. A tender with power auger or conveyor may substitute. Fertilizer should be from conventional derived sources and be in granular form. This Request For Quote (RFQ) will result in a Purchase Order. AGENCY SHALL DETERMINE, IN ITS SOLE DISCRETION, WHETHER A PRODUCT OFFERED IS "EQUAL." When the designation is "or equal" or "equivalent" Agency shall make its decision after Bid Closing. TERMINATION DUE TO FUNDING SOURCE: Agency may terminate the Contract, in whole or in part, immediately upon notice to Contractor, or at such later date as Agency may establish in such notice, upon the occurrence of any of the following events: (i) Agency fails to receive funding, or appropriations, limitations or other expenditure authority at levels sufficient to pay for the Goods to be purchased and/or the services to be provided under the Contract; or (ii) federal or state laws, regulations, or guidelines are modified or interpreted in such a way that either the purchase of Goods and/or services under the Contract is prohibited, or the Agency is prohibited from paying for such Goods and/or services from the planned funding source; or (iii) Contractor breaches any material provision of the Contract. Pursuant to this section, upon receipt of written notice of termination, Contractor shall stop performance under the Contract as directed by the Agency. ESTIMATE OF PURCHASES: It is estimated that the quantities in the items listed will be purchased on this request for quote. These figures are intended to serve only as a guide to bidders, and are not to be construed as a guarantee. All quantities are estimated, and are for bid purposes only. The Oregon Department of Fish and Wildlife (ODFW) reserves the right to adjust quantities, add or delete, as needed. WARRANTIES: Unless otherwise stated, all goods shall be new and current model and shall carry full manufacturer warranties. Contractor warrants all goods delivered to be free from defects in labor, material and manufacture and to be in compliance with solicitation specifications. All implied and expressed warranty provisions of the Uniform Commercial Code (ORS chapter 72) are incorporated in this contract. All warranties shall run to the State. ODFW reserves the right to cancel the solicitation, or reject in whole or in part, any or all quotes when the cancellation or rejection is in the best interest of the contracting Agency, in accordance with ORS 279B.100.
