The National Institute of Allergy and Infectious Diseases (NIAID) in support of Laboratory of Viral Diseases intends to negotiate on an other than full and open competition contract for a preventive maintenance coverage, repair service, and parts and service contract for a the FACSCalibur Flow Cytometer, FACS Flow Supply System and the High Throughput Sampler with BD Biosciences (2350 Qume Dr. San Jose, CA 95131). BD Biosciences is the original equipment manufacturer (OEM) of FACSCalibur Flow Cytometer, FACS Flow Supply System and the High Throughput Sampler, two (2) Preventive Maintenance (PM) inspections during the period of performance, including 2 PM, kits, 24-hour guaranteed response to a request for emergency on-site service, Software revisions released during the agreement, Unlimited service visits, Unlimited telephone support for instruments, reagents, and applications to be provided at no extra charge services and maintenance on these instruments while maintaining the equipment within a BSL-2 environment BD Biosciences does not authorize any third party vendors to conduct maintenance services on their equipment, and therefore subcontracting possibilities are not an option. This is not a request for proposal. Changing the parts and support services to the equipment at this time could introduce variables that may negatively affect the current project. The statutory authority for this sole source requirement is 41 U.S.C. 25(c) (1) as implemented by FAR 6.302-1 only one source available, no substitutions possible. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTATIONS ARE NOT BEING REQUESTED, AND A WRITTEN SOLICITATION WILL NOT BE ISSUED. The Government reserves the right to make a decision whether this requirement is available for competition.
