The U.S. Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA) intends to negotiate with authorized Kongsberg Underwater Technology for direct replacement of currently installed EK60 Sonar System, to include 1 each of Split Beam Transducer P/N KSV-203678-FR (ES-70-7C, 7 degree x 7 degree, 70kHz split beam operation, 20m cable), 1 each Mounting Ring for ES70-7C P/N ES7-203680 and 1 each Clamping Ring Assembly and Cable Gland for ES70-7C P/N ES7-203679 on board the NOAA Ship HENRY BIGELOW which is currently located AT Wood Hole MA.
The delivery date on or about December 1, 2008.
It is NOAA's intent to conduct this procurement in accordance with Federal Acquisition Regulation (FAR) part 12, Acquisition of Commercial Items and FAR part 13, Simplified Acquisition Procedures. The applicable NAICS is 333618. The Request for Quotation (RFQ) will only be posted to www.fbo.gov and will appear on or about September 24, 2008. Quotes will be due on or about November 4, 2008 at 12:00 pm EST. Anticipated award date is November 15, 2008. All responsible sources may submit a quote, which shall be considered by the agency. All potential vendors are encouraged to register as an Interested Vendor in FEDBIZOPPS. It is incumbent upon vendors to monitor FEDBIZOPPS for the release of the solicitation, specification, drawings, and all subsequent amendments. Vendors must be registered with the Central Contractor Registration (CCR) at www.ccr.gov under the applicable NAICS code - 334511. JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION
Pursuant to the requirements of FAR Part 13, Simplified Acquisition Procedures, Subpart 13.106-3(b) the justification for soliciting from a single source is supported by the following facts and rationale:
1. NOAA MOA-HB has a brand-name requirement for the overhaul of two Caterpillar D398 Engines located aboard the NOAA Ship GORDON GUNTER. Kongsberg Underwater Technology for direct replacement of currently installed EK60 Sonar System, to include Split Beam Transducer, Mounting Ring and Clamping Ring Assembly with Cable Gland. Kongberg is the original equipment manufacturer of the EK60 Sonar System; the parts required to overhaul this Sonar System are not interchangeable with other brands of Sonar Systems. The procedures to be employed to successfully accomplish the overhaul must be in accordance with Kongsberg service, maintenance and overhaul technical manuals, including service bulletins to ensure that the manufacturer's warranty is not compromised.
2. The synopsis and solicitation will be posted on FedBizOpps with the intent to solicit quotes only from authorized Kongsberg repair facilities with unique capabilities to satisfy NOAA's requirement. Quotes will be solicited only from Kongsberg dealers as they are the only vendors that are able to provide Kongsberg parts and warranty.
