This is published as a sole source announcement under the statutory authority at 10 U.S.C 2304(c)(1), as implemented by FAR 6.302-1, Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements. The Army Contracting Command, Aberdeen Proving Ground, Division E, Tobyhanna Branch, Tobyhanna Army Depot (TYAD), Tobyhanna, PA 18466 intends to negotiate and award a firm-fixed price contract on a sole source basis to L3 Technologies, Inc., Narda-MITEQ, 435 Moreland Road, Hauppauge, N.Y. 11788.

The requirement is for TYAD to acquire thirty-four (34) LEQ-100200-C32303 Equalizer Modules, L-BAND. L3 acquired the assets of MITEQ, Inc. on January 21, 2015. The MITEQ business was combined with L3's Narda Microwave-East business,and the new organization is called L3 Narda-MITEQ.

MITEQ and is the sole designer, developer and manufacturer of the RRFIS equalizer
module, and owns exclusive rights to the technical documentation. The Government does not have a Technical Data Package (TDP) suitable for competition for this requirement. L3 Narda-MITEQ is the only known supplier with proprietary rights with the requisite technical knowledge, capability, and unique insight into the manufacturing, engineering, design, integration, and system testing capabilities of the Equalizer Modules. No other company can manufacture the required part because the Government does not have any technical data for competition.IAW 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1 only one responsible source and no other supplies or services will satisfy agency requirements.

This notice of intent is not a request for competitive proposals. A determination by the Government not to compete this requirement based on this notice is solely within the discretion of the Government

Any responsible firms believing they can provide the required Equalizer Modules should within ten (10) days of this notice, contact in writing the Contract Specialist identified below and submit a capability statement describing their firm's capability to meet the Government's requirement which will be reviewed for consideration.
