The U.S. Department of Commerce, National Oceanic and Atmospheric Administration (NOAA) ,
Simplified Acquisition Branch intends to negotiate on a sole source basis with Myriax Softward PTY LTD ,
using procedures in FAR Parts 6 and 12 Simplified Acquisition Procedures. The Government intends to
purchase Echoview Software (see attachment) . This is proprietary Echoview software.
Award of a single firm fixed price Purchase Order is contemplated with a Period of Performance from date of award through January 2012. The source code is 70, the North American Industry Classification System (NAICS) code for this request for quotation is 541511. The North American Industry Classification System (NAICS) code cited in this request for quotation is for internal business size stratification purposes only, and is not meant to restrict this procurement to small business. The subject of the email should state Echoview software. The statutory authority for other than full and open competition is 41 USC 253©(1) as implemented by FAR 6.302-1., Only one response source. This is not a solicitation for competitive quotes. However, if any other interested party believes that they can meet the requirements, submit a statement of capabilities, which if timely received, will be considered by NOAA. The capability statement and any other information furnished must be in writing, and must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the foregoing requirements. Responses must be accompanied by descriptive literature, warranties, and/or other information that demonstrates that the quote meets all of the foregoing requirements. Capability statements and related materials must be e-mailed to [email protected] by April 28, 2011, 1:00pm., local time. Award will be made using FAR 13, Simplified acquisition procedures, current through FAC 2005-51. The determination to compete or not to compete the proposal contract based upon responses to this notice is solely within the discretion of the Government. The information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Period of Performance date of award through April 2012.
