The Department of Labor, Mine Safety & Health Administration, intends to award a sole source contract under the authority of U.S.C.253(c)(1), as implemented by FAR 6.302-1(b)(1)(i) - Only one responsible source and no other supplies or services will satisfy agency requirements, to Panalytical, Inc., 117 Flanders Road, Westborough, MA 01581 for a service contract that covers all labor costs, and travel expenses to make any needed repairs, within 48 hours, for the following government owned instruments : PW 1800 Diffractometer, s/n DY641; PW 1808 Sample Changer, s/n DY616 ; PW 1800 Diffractometer, s/n DY791; PW 1808 Sample Changer, s/n DY705. In addition the vendor will perform one preventative maintenance service visit per year to perform preventative maintenance and verify the proper functioning of the two paired diffractometers and sample changers listed above. This contract covers labor only and no parts coverage. This includes unlimited emergency calls and phone support during regular business hours. The contract includes a reduced rate of 20% on service parts. No software updates are included. These diffractometers and sample changers are located at USDOL - MSHA - Dust Division, 626 Cochrans Mill Road, Pittsburgh, PA 15236. This action will result in a firm fixed price contract. The period of performance will commence on or about April 1, 2012 for a twelve (12) month period ending on or about March 31, 2013. The NAICS code for this requirement is 334516 with a size standard of 500 employees.
