THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. This is a notice of intent to award a sole source contract. The Department of Homeland Security, Customs & Border Protection (CBP) intends to award a 9-month  contract on a sole source basis under statutory authority 41 USC 3304(a)(1), set forth in Federal Acquisition Regulation (FAR)  6.302-1, "Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements."

CBP requires activation of services and intends to make an award to Busy Bee Septic Services located at 160 Arizona Road, SW, in Deming, New Mexico.  The proposed contract action is for the following activities:

•1.     Delivery of bulk potable water to the Highway 11 temporary checkpoint an average of 1.5 times per week for trailer sanitation and fan cooling.

•2.    Removal and disposal of black water collection from the checkpoint an average of three times per week.

•3.    Rental and cleaning of one portable toilet at the Highway 11 Checkpoint with cleaning once per week.

•4.    Rental of two portable toilets at the Highway 26 temporary checkpoint with cleaning twice per week.

The purchase request number, 20070298, lines 10 - 40, is issued as the request for quotes (RFQ) unless otherwise indicated herein. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-60. The associated North American Industrial Classification System (NAICS) is 562998, All Other Miscellaneous Waste Management.  Busy Bee Septic is the only known source that meets all of the Government's existing requirements for the Highways 11 and 26 Checkpoints. The Government will consider all capability statements received by the closing date of this notification.  A determination by the Government not to compete based on responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. Based on the above information, the only technically acceptable products for this requirement are provided by Busy Bee Septic.  Please submit email capability statements (using PDF, MS Word, Excel attachments) to Russell Brehm at [email protected] .
