The Government intends to enter into a firm-fixed-price contract with Phoenix Wireless Data System Inc, 3255 Lawrenceville Suwanee rd, Ste P 213, Suwanee GA. The Mission and Installation Contracting Command (MICC), Fort Campbell, KY, has a requirement for 10 (ten) NightHawk Mobile Data Client and Server Software Licenses, 10 (ten) Microsoft MapPoint 2013 Programs, and a one year contract for 24/7 Support (See (1) attachment - Sole Source J&A). The procurement will be conducted on a sole source basis in accordance with the statutory authority of 10 U.S.C. 2304(c)(1) as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. The basis for restricting competition is that the Nighthawk Software can only be provided by the sole proprietor, Phoenix Wireless Data System Inc. NAICS code for this procurement is 511210 and the small business size standard is $35.5M. This sole source requirement will be procured under Simplified Acquisition Procedures (FAR 13.5) using Other Than Full and Open Competition, and awarded on an unrestricted basis. THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE OFFERS and a solicitation will not be issued; however, any firm that believes it can meet the requirements may give written notification to the Contracting Officer within 5 days from the date of the publication of this synopsis. Responses received will be evaluated; however, a determination by the Government not to compete the proposed procurement based upon responses to this notice is solely within the discretion of the Government.
