Sealed Bids for the construction of the Corby Road Reconstruction Project will be received by Courtdale Borough, online until 12:00 PM local time on August 20, 2019, at which time the Bids received will be publicly opened and read. The Project consists of roadway reconstruction for Corby Road in the Borough of Courtdale, Luzerne County. The base bid includes the removal of existing pavement and the placement of new subbase, binder, and wearing courses over an area measuring approximately 3,100 square yards. A bid alternate includes the removal of existing pavement and placement of new subbase, binder, and wearing courses over an additional area measuring approximately 1,700 square yards. Bids will be received for a single prime Contract. Bids shall be on a unit price basis, with additive alternate Bid items as indicated in the Bid Form. Sealed bids shall be accepted online through the PennBID Program. Bidding Documents and solicitation details may be viewed and available at no cost online by registering at www.PennBID.net. Following registration, complete sets of Bidding Documents may be downloaded as portable document format (PDF) files. The date that the Bidding Documents are transmitted by the Issuing Office will be considered the Bidder’s date of receipt of the Bidding Documents. A pre-bid conference will not be held. Bid security in the form a Certified Check or Bid Bond shall be furnished with the bid in an amount not less than 10%. All questions about the meaning or intent of the Bidding Documents are to be submitted via the PennBID Program in accordance with the Instructions to Bidders. Telephone inquiries are unacceptable. All bids shall be irrevocable for 60 days after the bid opening date unless award is delayed by a required approval of another government agency, the sale of bonds, or the award of a grant or grants, in which case this Bid shall remain subject to acceptance for 120 days after the bid opening date as provided by the Act of November 26, 1978 (P.L. 1309, No. 317), as amended by the Act of December 12, 1994 (P.L. 1042, No. 142). Bidders must comply with all State antibid-rigging regulations pertaining to work associated with this project, and will be required to submit an executed non-collusion affidavit with the bid. The project is funded through the Luzerne County Community Development Block Grant (CDBG) Program. The estimated cost of this Project is greater than Two Thousand Dollars ($2,000) and the federal Davis-Bacon Act shall apply. Attention is called to the fact that not less than the minimum salaries and wages as set forth in the Contract Documents must be paid on this project; that the Contractor must ensure that employees and applicants for employment are not discriminated against because of their race, age, color, religion, gender, national origin, or physical disability; that a mandatory ratio of apprentices and trainees to journeymen is required in each craft and the Contractor (and any subcontractor) is obliged to make a “diligent effort” to achieve these ratios; and that to the greatest extent feasible, opportunities for training and employment be given to lower income residents of the project area and must, to the greatest extent feasible, utilize project area businesses located in or owned in substantial part by project area residents. This project is funded by federal sources. Bidders must comply with all funding requirements as described in the Project Manual, and submit all required documentation of compliance. The Labor Standards, Wage Determination Decision, and Anti-Kickback regulations (29 CFR, Part 3) issued by the Secretary of Labor are included in the contract documents of this project and govern all work under the contracts. In addition to EEO Executive Order 11246, Contractors must also establish a 6.9% goal for female participation and a 0.6% goal for minority participation, and a 10% goal for Section 3 participation, in the aggregate on-site construction work force for contracts in excess of $10,000 as per the notice of requirement for affirmation action as contained in the contract documents. Attention is called to Section 3 of the Housing and Urban Development Act of 1968, 12 USC 179 LU and the Section 3 clause and regulations set forth in 24 DFR, Part 135. In accordance with Executive Orders 11625, 12138, the contractor must utilize, to the greatest extent feasible, minority and/or women owned business concerns. This Project falls under The Commonwealth of Pennsylvania enacted Act 127 of 2012, known as the Public Works Employment Verification Act (‘the Act’) which requires all public work contractors and subcontractors to utilize the Federal Government’s E-Verify system to ensure that all employees performing work on public work projects are authorized to work in the United States. All Bidders are required to submit a Public Works Employment Verification Form as a precondition for the Contract Award.
