This requirement has a Section 508 E&IT Exception in accordance with FAR 39.204(b) is for a national security system. Such exception is documented and filed in contract folder. Therefore, requested items are not required to be compliant with Section 508 for this requirement. This acquisition is for additional Concordance licenses for recent hires. The mission of the NSD is to carry out the Departmentâs highest priority: to combat terrorism and other threats to national security. The Criminal Division, United States Attorneyâs Offices and sections of the National Security Division utilizes Concordance databases and imaging software for litigation support applications. NSD requires Concordance and Concordance Image litigation support software to assist in organizing data, document images, transcripts, etc. for various cases and matters. This software will enhance NSDâs ability to prepare cases for trial and to manage and organize discovery documents and data. This requirement for additional licenses will accommodate NSDâs expanding staff.
Solicitation DJJ-APG-9-T-101 is issued as a Request for Quotation (RFQ). This is a competitive brand name acquisition. The North American Industry Classification Systems (NAICS) code for this requirement is 511210 with a size standard of $21M. A firm fixed price purchase order will be issued. The Government will award a contract resulting from this solicitation to the responsible contractor whose quote conforming to the solicitation provides the most advantageous price to the Government. This solicitation document and incorporated provisions and clauses are those that are in effect through Federal Acquisition Circulars 2005-20 effective 6 Sept 2007. The following FAR provisions and clauses apply to this acquisition and are incorporated by reference: FAR 52.212-1, Instructions to Offerors - Commercial Items- FAR 52.212-4, Contract Terms and Conditions- Commercial Items - FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders- Commercial Items. Clause 52.212-5 further incorporates the following: 52.219-6, 52.219-28, 52.222-3, 52.222-19, 52.222-21, 52.222-26, 52.222-35, 52.222-36, 52.222-50, 52.225-13, 52.232-33 and 52.239-1. The NSD presently uses this software and needs additional software licenses and maintenance support for consistency of operation and efficiency of use. Therefore, in order to maintain software compatibility, this requirement is brand specific to the specified software.
