DESCRIPTION:
The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Comsol, inc of Burlington, MA for the purchase of Comsol Multiphysics software.
This will be under other than full and open competition by the authority of FAR 13.106(b)(1). Only one responsible source and no other supplies or services will satisfy agency requirements:

Specifically no other vendor can meet the NIST requirements for:
Comsol Multiphysics is used for several projects within the Nanofabrication Research Group at the CNST. Acquisition of a new license is required due to new projects and users within the group, and continued use of Comsol Multiphysics is a necessity to maintain compatibility with existing research efforts. Including those which involve our external users that work with this software. Vendor has indicated that they do not have contractual agreements with any companies to be resellers of their products.
The North American Industry Classification System (NAICS) code for this acquisition is 511210, and the size standard is $35.5 mil.
No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement.
