The Centers for Disease Control and Prevention, National Center for Environmental Health Division of Laboratory Sciences (DLS), intends to award a sole source firm-fixed price contract, to procure a service contract for maintenance on the CEM Peptide Synthesizer to CEM Corporation 3100 Smith Farm Road, Matthews, NC 28106. The CEM Peptide Synthesizer is used for synthesis of peptides, research and development of methods to detect protein toxins, cardiovascular proteins, and influenza proteins. The instrument is also capable in making the peptide reagents critical to these scientific areas. The instrument periodically needs annual preventative maintenance and repairs on an as needed basis.
As the original equipment manufacturer of the CEM Peptide Synthesizer, CEM Corporation is the only contractor that can provide: a) on-site repair of the CEM Peptide Synthesizer; b) preventive maintenance and emergency repair actions during normal business hours; c) staff qualified to diagnose problems and repair and maintain CEM equipment; d) CEM Corporation supplements their own Field Engineers and they periodically receive service information and updates, often consisting of compilations of recent problems and suggested methods of correction. Finally the original equipment warranty information states that the manufacturer only ensures performance at original levels if genuine manufacturer parts or manufacturer trained technicians provide service for equipment that they have previously maintained.
The statutory authority for this sole source acquisition is U.S.C. 2304 (c) (1) in accordance with FAR Part 6.302-1 only one responsible source and no other supplies or services will satisfy the agency requirements. The NAICS code for this procurement is 811219 Laboratory Instrument and Maintenance Services with size standard of 1,000 employees.
No solicitation will be posted to FedBizOpps. This notice of intent is not a request for proposal. A determination by the government not to compete the proposed purchase order based upon responses to this notice is solely within the discretion of the Contracting Officer.
