The Naval Air Warfare Center Aircraft Division Lakehurst, NJ intends to negotiate on a non-competitive basis with EADS North America, Inc., 2550 Wasser Ter Suite 9000, Herndon, VA 20171-6177 for the procurement of Original Equipment Manufacturer (OEM) operational-level aircraft systems and engine spare parts, ground support equipment, pilot and maintenance personnel training, and on-site field service representative (FSR) technical support in the Republic of Yemen for one (1) Construcciones Aeronauticas, S.A. (CASA) CN-235-300 variant fixed-wing tactical heavy-lift aircraft in support of NAVAIR's Counter Networks and Illicit Trafficking (CNIT) Program Office. The CASA CN-235-300 aircraft is currently is storage at the OEM's facility in Seville, Spain and destined for delivery and transfer to the Yemen Air Force.

The Government intends to procure the above items under the authority of 10 USC 2304 (c) (1), FAR 6.302-1. The Government does not own technical data, drawings, or other specifications to permit full and open competition. All responsible sources are encouraged to submit a proposal in writing that may be used by the Government in determining whether or not to conduct a competitive procurement. A determination by the Government not to open the requirement to competition based upon the response to this notice is solely within the discretion of the Government.
