DESCRIPTION:
The Department of Commerce, National Institute of Standards and Technology (NIST), intends to negotiate a firm fixed price purchase order, on a sole source basis, with Bruker Daltonics of Billerica, MA for the purchase of a service agreement for a Bruker MicrOTOF II mass spectrometry instrument under other than full and open competition by the authority of FAR 13.106(b)(1). Only one responsible source and no other supplies or services will satisfy agency requirements:
A sole source determination is based on the following: Only Bruker Daltonics can meet our technical requirements.
Specifically no other vendor can meet the NIST requirements for:
Service Agreement for a Bruker MicrOTOF II mass spectrometry instrument.
NIST is the current owner and Bruker is the original manufacturer of the equipment.
Bruker is required because the preventative maintenance, parts, software upgrades, and any repairs arising during the use of this instrument must be performed by factory trained personnel because the company has proprietary rights to the design and software utilized in this instrument; it is the only company with access to performance-verified component parts, spare parts, software, technical support, upgrades and engineering resources to maintain the original operating specifications of this instrument.
There are no other re-sellers.
A base and four options are planned for the award.
The North American Industry Classification System (NAICS) code for this acquisition is 811219, and the size standard is $19.mil.
No solicitation package will be issued. This notice of intent is not a request for competitive quotations; however, interested persons may identify their interest and capability to respond to this requirement. The Government will consider responses received by 12:00 p.m. (EST) on December 30, 2013. Inquiries will only be accepted via email to [email protected]. No telephone requests will be honored.
A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive procurement in the future.
