Notice of Intent to Sole Source

The U.S. Consumer Product Safety Commission (CPSC) announces its intention to negotiate and issue a sole source award to EC America, 8444 Westpark Drive, Suite 200, McLean, VA 22102 for Appian software licenses.

CPSC’s Dynamic Case Management system is a production database used by CPSC’s compliance office and utilizes Appian software.  Appian has a per user license model.  CPSC increased staffing for the compliance office, resulting in the need to procure additional licenses beyond the initial renewal procured in 61320621P0010. CPSC’s goal will be affected and the agency will not be able to process unregulated and section 15 cases if additional Appian licenses are not procured.

EC America Inc. is the only authorized government reseller for Appian products, therefore no other source can meet CPSC’s requirement and this requirement will be issued as a sole source.

CPSC intends to negotiate this requirement under the authority of FAR 13.106 1(b) and 41 U.S.C. 3304(b)(2)(B). The sole source procurement will be awarded as a simplified acquisition in accordance with FAR Subpart 12 & FAR Subpart 13 procedures. Interested persons may identify their interest and submit a capability statement demonstrating their ability to meet this requirement.

This notice of intent is not a request for competitive quotations; however, all quotations/responses received within ten (10) business days of the issuance of this notice will be considered by the government. A determination by the government not to compete this proposed procurement based upon responses to this notice is solely within the discretion of the Government.
