This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, in conjunction with FAR 13.5, as applicable, and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, a written solicitation will not be issued. The solicitation number is 2012-48565. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular FAC 2005-46. The associated North American Industrial Classification System (NAICS) code for this procurement is 541711 with a small business size standard of 500 employees. Proposals are due by September 12, 2011 at 12:00 p.m. The place of performance is Centers for Disease Control and Prevention, 1600 Clifton Road, Building 18, Atlanta, GA 30333. The approximate delivery date is October 15, 2012. The Centers for Disease Control and Prevention (CDC) intends to issue a sole source, firm fixed price contract award to Genscript USA, Inc., 860 Centennial Avenue, Piscataway, NJ 08854, for a quantity of 1 Antibody Panel for Legionella pneumophila and shipping charges. This procurement will be processed under the authority of FAR 13.106-1(b)(1). Only one responsible source will satisfy the Agency's requirements because this vendor is uniquely suited to reproduce the Legionella monoclonal antibody panel originally described in 1983. This notice of intent is not a request for competitive quotes/proposals, however, all responsible sources may submit a capability statement with a cost proposal and a completed copy of the provision at 52.213-3, Offerors Representations and Certifications - Commercial Items which, if received by the response date, shall be considered by the Agency. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within discretion of the Government.

The following provisions apply to this commercial solicitation: 1. FAR clause 52.212-1, Instructions to Offerors - Commercial, applies to this acquisition and a statement regarding any addenda to the provision. 2. FAR clause 52.212-2, Evaluation - Commercial Items, if used, and the specific evaluation criteria to be included in paragraph (a) of that provision. If this provision is not used, describe the evaluation procedures to be used. 3. Offerors are to include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications - Commercial Items, with its offer. 4. FAR clause at 52.212-4, Contract Terms and Conditions - Commercial Items, applies to this acquisitoin and a statement regarding any addenda to the clause. 5. FAR clause at 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders - Commercial Items, applies to this acquisition and a statement regarding which, if any, of th eadditional FAR clauses cited in the clause are applicable to the acquisiton. 6.
