The Naval Air Warfare Center Aircraft Division (NAWCAD), New Jersey intends to procure two (2) ALM-288 Countermeasure Test Set units NSN: 4920-01-423-8143 P/N 188100?7001 on a sole source basis with BAE Systems. These ALM-288 Countermeasure Test Set units are being used to perform fast and reliable flight line safety and functional checks of the countermeasure dispenser system on the KC-130J platform. Under the authority 10 USC 2304(c)(1), FAR 6.302-1, the Government intends to issue a sole source contract to BAE Systems, as BAE Systems is the only responsible source capable to provide this product. These units are deemed to be available only from one responsible source when it is likely that award to any other source would result in substantial duplication of cost to the Government that is not expected to be recovered through competition. The Government does not own the technical data required to competitively award this requirement. THIS IS NOT AN INVITATION FOR COMPETITVE PROPOSALS. This acquisition is being pursued on a sole source basis under the statutory authority of 10 USC 2304(C)(1), as implemented in FAR 6.302-1, only one responsible source and no other supplies or services will satisfy agency requirements. This notice of intent is not a request for competitive proposals; however, the Government will consider all responses received to this notice. A determination by the Government not to compete this requirement is solely within the discretion of the Government.
