The Naval Air Systems Command (NAVAIR) intends to enter into sole source negotiations with Raytheon, McKinney, Texas and subsequently award contract actions for approximately 566 AGM-65E2 GCS modification kits. This contract action will be issued on a sole-source basis under the authority of 10 U.S.C. 2304(c)(1) and FAR 6.302-1, "Only One Responsible Source and No Other Type of Supplies or Services will Satisfy Agency Requirements."  Raytheon is the sole designer, developer, and manufacturer of the AGM-65E2 missile, and as such, is the only known source available with the requisite technical knowledge, experience, and proprietary software algorithms necessary to perform the requirements described herein to satisfy the Government's requirement. This is a re-synopsis of a presolicitation notice posted on December 18, 2012 via presolicitation N00019-12-P4-PC103.

This synopsis is published for informative purposes (THIS NOTICE IS NOT A REQUEST FOR COMPETITIVE PROPOSALS).  Interested parties, however, may identify their interest and capability by responding to the requirement.  The Government will consider all capability information received prior to the closing date of this synopsis.  Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.  A determination by the Government not to compete the proposed contract modification based upon responses to this notice is solely within the discretion of the Government.  There is no commitment by the Government to issue a solicitation, make an award(s), or be responsible to any money expended by interested parties before award of a contract for the effort described above. Information provided herein is subject to change and in no way binds the Government to solicit for or award a contract.
