PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE PUBLISHED. The Federal Bureau of Investigation (FBI) intends to negotiate a one-time sole source contract with Agilent Technologies, 2850 Centerville Road, Wilmington, DE 19808. The Government intends to negotiate with only one source under the authority of FAR 6.302-1.

This notice will be distributed solely through the General Services Administration's Federal Business Opportunities (FBO) Website (www.fedbizopps.gov). Interested parties are responsible for monitoring the FBO site to ensure they have the most up-to-date information about this acquisition. The North American Classification System Code is 811219, Analytical Laboratory Instrument Manufacturing; the size standard is 750 employees.

The FBI Laboratory is currently collecting DNA samples from Federal, Military and District of Columbia Convicted Offenders as outlined in the DNA Backlog Elimination Act of 2000, USA Patriot Act of 2001 and the Justice For All Act of 2004. Recent passage of the DNA Fingerprint Act of 2005 expands the scope of collection to include all Federal arrestees as well as non-US citizen detainees. In order to comply with this legislation and be able to process the exponential increase in samples being submitted to the FBI, the program has a need to acquire the Agilent Seal. The Robots used by the FBI are using the Agilent Plate Loc sealer to prevent evaporation during the processing of the samples as well as preventing contamination of the samples. The type of sealing material that is used is specific for the plates that FBI utilizes for the processing of samples, as well as being specific for the Agilent Plate Loc sealer located on the robots.

The seals requested are only sold and manufactured by Agilent Technologies. The seal made by Agilent Technologies is specifically made to fit the Agilent Plate Loc sealer that fits on all robots used by the FBI.

Based on market research conducted and contacts made with knowledgeable individuals within the government and related industry, it has been determined the FBI's requirement can only be provided by Agilent Technologies, as no other vendor is capable of providing the Agilent Seal that is needed for direct support of the FBI's mission.


This notice of intent is not a request for competitive quotations; however, interested parties may identify their interests and capability to respond to this requirement or submit proposals to this office by 08:00 am, EST, by July 02, 2012, by email to the attention of Jerry Varnell, Contract Specialist, at [email protected]. Information received will be considered solely for the purpose of determining whether or not to conduct a competitive procurement. Telephone requests will not be considered. A determination by the Government not to compete this proposed contract based upon response to this notice is solely within the discretion of the Government.

The awardee shall be registered in the Central Contractor's Database (CCR) and also the Online Representations and Certification (ORCA) at http://orca.bpn.gov.
