The National Institute of Allergy and Infectious Diseases (NIAID) intends to negotiate on an other than full and open competition for an additional Flow Cytometric equipment upgrade for the BD Flow Cytometric system with BD Biosciences and is the original equipment manufacturer (OEM) of the Fortessa equipment and they do not have any authorized third party resellers for this particular product. This is not a request for proposal. All responsible sources who are certified by BD Biosciences as authorized third party resellers/service providers may submit a proposal showing their capabilities and past performance repairing this type of equipment. The vendors shall provide certification from OEM that they are authorized reseller/service provider and have access to OEM parts and supplies. All responsible sources may submit a response that will be considered. This will be a firm fixed price contract in accordance with the statutory authority for this sole source requirement 41 U.S.C. 253 (c) (1) as implemented by FAR 6.302-1 only one source available, no substitutions possible, and equipment must be compatible with existing systems. A determination not to compete this requirement, based upon responses to this notice, is solely within the discretion of the Government. Offers must be submitted no later than P.M.
