***AMENDMENT 1: This solicitation is amended to clarify the following:

- DFARS Clause 252.211-7003 ITEM UNIQUE IDENTIFICATION AND VALUATION (JAN 2023) is not applicable, meaning the ABAV Kits DO NOT require serialization/UID

- Offers for all line items should be based on the sizes called out in the solicitation (Attachment "23Q0007 ABAV Kits.docx") and not the NSN #'s listed

- At this time, the government will NOT consider offers that deliver supplies after 01 Sept

(i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this noticeQ. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued.

(ii) Solicitation W50S6L-23-Q-0007 is issued as a Request for Quote (RFQ).

(iii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2023-03, effective 26 April 2023.

(iv) This requirement is totally set-aside for Small Business concerns. The North American Industrial Classification System (NAICS) code associated with this procurement is 315990 with a small business size standard of 500 employees.

*** NOTE: Items MUST be delivered NLT 01 SEPT 2023 to be considered for award. Vendors are encouraged to submit multiple offers/quotes for various shipment methods to expedite and meet govt requested 01 Sept 23 delivery date (ie ground trans vs overnight air, etc). ***

(vii) FAR 52.212-1 Instructions to Offerors -- Commercial Items (Jul 2021) is hereby incorporated by reference, with the same force and effect as if it were given in full text.

(vii) The Government intends to award a Firm-Fixed Price contract to the offeror that represents the best value to the government.

(ix) FAR 52.212-2 Evaluation -- Commercial Items (Oct 2014) this provision has been tailored to this procurement and is provided in full-text below:

            a.         The Government will issue a delivery order resulting from this solicitation to the   quoter whose quote, conforming to the solicitation, will be most advantageous to the        Government, price and other factors considered. The following factors shall be used to       evaluate quotes:

                        (1)        Technical acceptability

                        (2)        Price

                        (3)        Past Performance

            b.         Technical acceptability: The government will evaluate quotes on the basis of                     whether or not the provided quote is technically acceptable. The Contracting Officer will evaluate "equal" products (if applicable) on the basis of information furnished by the           quoter or identified in the quote and reasonably available to the Contracting Officer. The        Contracting Officer is not responsible for locating or obtaining any information not      identified in the quote.

            c.         Price: Price will be evaluated for fairness and reasonableness.

            d.         Past Performance: Past Performance will be evaluated in accordance FAR 13.106-            2(b)(3)(ii). The Contracting Officer may evaluate past performance based on customer     surveys, the Contractor Performance Assessment Reporting System (CPARS), or any   other reasonable basis. The contracting officer may use his/her previous experience with           the items and services being acquired.

(x) Each vendor shall ensure the provision at FAR 52.212-3 including its Alternate I, Vendors Representations and Certifications--Commercial Items (Feb 2021) are updated at www.sam.gov. Failure to obtain SAM registration will result in submissions not being considered for award.

(xi) The clause at FAR 52.212-4, Contract Terms and Conditions—Commercial Products and Commercial Services (Dec 2022), is hereby incorporated by reference, with the same force and effect as if it were given in full text.

(xii) The clause at FAR 52.212-5, Contract Terms and Conditions Required To Implement Statutes or Executive Orders—Commercial Products and Commercial Services (Dec 2022), is hereby incorporated by reference, with the same force and effect as if it were given in full text. Additionally, the following provisions/clauses apply to this acquisition: see attachment titled “Provisions-Clauses”.

(xiii)No additional contract requirements apply to this acquisition.

(xiv) This acquisition does not require a Defense Priorities and Allocations System (DPAS) rating.
