The NAICS 423620 (Household Appliance, Electric House wares, and Consumer Electronics Merchant) applies to this Pre-solicitation notice and any subsequent contract vehicle. Responses to this notice shall not constitute a response to a solicitation, which is not currently available. As stipulated in FAR 15.201(e), responses to this notice are not considered offers and cannot be accepted by the Government to form a binding contract. The decision to solicit for a contract shall be solely the Government's discretion. This sources sought notice is not to be constructed as a commitment by the Government, nor will the Government pay for the information submitted in response. Respondents will not be notified of the results of any government assessments. The information received will be utilized to assist in formulating the strategy for competitive requirements.

The US Army 409th Theater Contracting Center, Kaiserslautern Germany intends to issue a solicitation for a Firm-Fixed Price IDIQ contract for Refrigerators (9.5) and Microwaves with a minimum Quantity of 300 with a maximum quantity of 5000. Spread over the order life of 1 to 5 years.

Combination, FOUR STAR, in 2-door TOPMOUNT design, i. e. freezer on top of refrigerator with separate door. Free standing. With NO FROST technology in refrigerator AN freezer compartment, i.e. ventilated in both compartments. (Size: 9.5 Cubic Feet)Make: Whirlpool, Model: WTE 2922NFW,or equivalent.

Further specifications and requirements are outlined below.

The Government requests demonstration of capability by all interested parties through the following means:

2. A short concept of operation execution.

1. GENERAL REQUIREMENTS.

a. The item offered shall be new, of modern design, from the manufacturer's current production and shall meet the item description above and the requirements specified below.

OFFERORS SHALL SUBMIT A COPY OF THE FOLLOWING ITEMS WITH THEIR OFFER, FAILURE TO SUBMIT SUFFICIENT INFORMATION ON ALL 6 ITEMS, SHALL RESULT IN A TECHNICALLY UNACCEPTABLE RATING:


b. Offerors shall submit with their offer:
1. Detailed technical literature. The literature shall display all relevant data and features required in this specification and questionnaires.
2. CE Conformance and certification.
3. Either one of the following certificates VDE or TUEV, UL, CSA, BEAB.
4. ISO 9001:2000 certificate.
5. Applicable commercial warranty copy for the item offered.
6. Any required data and features not displayed shall be commented in writing by the offeror in an unambiguous way with regard to their existence or non-existence.

c. In the Addendum to FAR 212-1, a questionnaire containing some key questions pertaining to the item offered shall be completed by the offeror. Offerors are required to answer all questions in writing. Besides answering all questions on the questionnaire, the item shall meet all other requirements as outlined in detail in this specification package.

d. If the offered model
- is not a readily available commercial product, or
- is a commercial product proposed to be modified to meet the specifications stated herein, or
- has not been previously supplied to nor inspected by the Government for determination whether the product meets the requirement as stated herein, then the awardee shall on request by the Government deliver a pre-production sample prior to the mass production. In such case, the offeror shall provide the pre-production sample within 30 calendar days after issuance of delivery order to the address given below. The Government will examine the sample to ensure that the specifications as offered are met and, if affirmative will accept the sample in writing. It is the responsibility of the contractor to provide an equal substitute in cases of previous models being discontinued or modified to a point which the selected model no longer meets the specifications provided herein.

e. The government is responsible for the unloading of deliveries at the destination as well as responsible for any
damages caused during the unloading process. However, any damage which may be incurred by items during
the transportation to the delivery location is the responsibility of the vendor who was awarded the procurement
contract.

3. CONFORMANCE AND CERTIFICATION:
The appliance shall conform to the European Communities directive CE, and each appliance shall carry the CE mark. Besides the CE mark, the appliance shall carry the VDE or TUEV certification or the UL or CSA or BEAB listing mark on its data plate as proof of having passed a test at one of these institutes. (NOTE: The receiver of the appliances will examine the legality of the certification/listing mark!).

4. QUALITY MANAGEMENT SYSTEM:
The appliance shall be manufactured within the scope of a quality management system according to ISO 9001:2000 which shall be certified by a recognized institute. The offeror shall provide such compliance by submitting a copy of the corresponding certificate upon request prior to contract award.

5. USER'S INSTRUCTION MANUALS, REPAIR MANUALS.

a. The contractor shall provide 3 each user's instruction manuals in English language and 3 each repair manuals preferably in English language with the proposal to the following address:

b. The repair manual shall comprise parts lists with spare parts numbers, drawings exploded view drawings, and a trouble shooting guide. In case of contract award the offereoror shall submit repair manual with the first delivery of appliances in hard copy and CD free of charge for the Government.


c. THE NAME OF THE MANUFACTURER AND THE MODEL NUMBER MUST BE IMPRINTED ON THE FRONT PAGE OF ALL MANUALS, AND IT MUST BE THE SAME NAME AND NUMBER AS ENTERED BY THE OFFEROR UNDER quote mark MAKE AND MODEL OFFERED quote mark .

6. SPARE PARTS
The offeror shall provide with the proposal at least one source for spare parts procurement for the item(s) offered. The following information about this source shall be provided: Name of Company, Address, Contact person, Telephone number, Fax Number and Email address.

7. REPLACEMENT OF MODELS
During the contract period the beneficiary of contract may request approval to substitute the offered model with a different model without additionally costs to the Government when production line changes occur.

8. COMMERICAL WARRANTY
The contractor shall provide a copy of the applicable commercial warranty with each item covered by such a warranty at no additional cost to the Government.
