The Department of Veterans Affairs, Albany, Buffalo and Syracuse NY VA Medical Center intends to award a firm fixed price sole source contract under the authority of 41 U.S.C. 253(c)(1) and FAR 13.106-1(b)(1)(i), only one source to: Cepheid 904 Caribbean Drive Sunnyvale, CA 94089 The objective of this sole source award is for a Base + 4 Option Year Contract to acquire supplies for the VA Owned GeneXpert DNA Analyzer. Sole source is based on only one responsible source as Cepheid is the manufacturer of GeneXpert DNA Analyzer. The reagents and test kits will be used in the Cepheid Genexpert equipment. According to the manufacturer, there are not any substitutes for reagents that will work in equipment. Additionally, the original equipment manufacturer states that it does not use third party companies as distributors and that it is the only source of these proprietary reagents. The Veterans Health Administration prohibits the use of "gray market" items in its facilities. Gray market items are those items outside of the original equipment manufacturer's intended distribution channels.
