The U.S. EPA intends to negotiate on a sole source basis, under the authority of FAR Part 6.302-1, with Biomerieux INC, for BioBalls for the Office of Water?s (OW) Office of Ground Water and Drinking Water (OGWDW) in Cincinnati, OH. EPA has identified Biomerieux, INC. as the only provider of the BioBalls with 5000 CFU of non-pathogenic E. coli KS10 containing the plasmid pKS10 and for the validation of the E. coli O157:H7 to meet the requirements of this procurement. Biomerieux, INC. is the only known source able to satisfy the Governments requirement because, as the manufacturer of the patented supply, they are the only source qualified to provide the BioBalls for this type of detection. This procurement will be accomplished under FAR Part 12 Commercial Procedures. Interested firms may identify their interest and capability to respond to the requirements. THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE QUOTATIONS. A determination by the Government not to compete this acquisition based upon responses to this notice is solely within the discretion of the Government.
