This acquisition is being pursued on a sole source basis under the statutory authority 10 U.S.C. 2034(c)(1), as implemented by Federal Acquisition Regulation (FAR) Part 6.302-1, only one responsible source. Miteq Inc. is the sole designer, developer, and producer of the required electrical equipment and holds the proprietary data rights. Therefore, Miteq is the only firm possessing the required knowledge, expertise, and data necessary to provide the essential equipment and repairs with the compatibility and interchangeability necessary for immediate integration into existing systems. A determination not to compete this procurement action based upon responses to this notice is solely within the discretion of the government.
