By way of this Sources Sought Notice, the United States Army, National Capital Region Contracting Center intends to determine the extent of capable firms that are available to perform the services discussed below.

The responses to this Notice will be used for planning purposes for an upcoming procurement. Therefore, this Notice does not constitute a Request for Proposal (RFP); it does not guarantee the future issue of a RFP; nor does it commit the Government to contract for any supply or service whatsoever. Respondents are advised that this Agency will not pay for any cost incurred in response to this Notice. All costs associated with responding to this Notice will be solely at the responding party's expense. At this time, proprietary information is not being requested, and respondents shall refrain from providing proprietary information in response to this Notice. Please be advised that all submissions become Government property and will not be returned. Not responding to this Notice does not preclude participation in any future RFP, if issued. In accordance with FAR 15.201(e), responses to this notice are not offers and cannot be accepted by the U.S. Government to form a binding contract.

This is a Sources Sought to locate a source for (1) fabrication and production delivery of the MD-1366(U) Strategic Enahanced Bandwidth Efficient Modem (EBEM) (NSN 5895-01-519-2525), MD-1366A(U) Tactical EBEM (NSN 5895-01-519-2415), and Ethernet Service Expansion Module (ESEM) (NSN 7025-01-562-9643); and (2) potential capabilities enhancement. The EBEM technical requirements are described in the EBEM performance specification, No. DCSS52513, revision 5, dated 14 December 2007.

The Government does not own any rights to the technical data that is required to design, develop, manufacture, and test of Strategic EBEM, Tactical EBEM, and ESEM. The technical data rights to design, develop, manufacture, and test are propietary and are the sole property of the current source: ViaSat, Inc., 6155 El Camino Real, Carlsbad, CA 92009.

Any manufacturer or supplier capable of fabricating and performing capability enhancements of these units must demonstrate meeting the functionality and performance requirements by First Article Testing (FAT). The manufacturer or supplier is required to supply First Article and Production Acceptance test results. The manufacturer or supplier shall be able to demonstrate with units that meet physical, functional, and performance requirements as described in the EBEM performance specification. Successful manufacturers or suppliers will be required to warrant that the item supplied will satisfactorily perform when used for the purpose intended by the Army.
