The Naval Special Warfare Development Group, Virginia Beach, Virginia has a potential requirement to procure the following: 1) CLIN 0001: 200 each 48” x 60” sheets of O.F. 200 Level 2 Bullet Resistant Fiberglass Panels, 200 each 4” x 60” Batten Strips. This procurement will be accomplished using full and open competition procedures for Commercial-Off-The-Shelf Items. This synopsis/solicitation is prepared in accordance with the format in FAR Subpart 12.6 as supplemented with the additional information included in this notice. This announcement constitutes the only solicitation; quotes are being requested and a written solicitation will not be issued. This solicitation is issued as a Firm Fixed Price (FFP) Request for Quotation (RFQ) H92244-04-Q-0058. Submit written offers: oral orders will not be accepted. This procurement is being issued as a 100% SMALL BUSINESS SET-ASIDE. This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Regulation FAC 2001-23, effective 5 May 2004. North American Industrial Classification Standard (NAICS) 334119, size standard 1,000 employees, applies to this procurement. FOB: Destination NSWDG, 1636 Regulus Avenue, Virginia Beach, Virginia 23461-2097. The Government desired delivery date is 4 weeks after date of contract. The following provisions and clauses apply to this acquisition: The provision at 52.212-1 Instructions to Offerors – Commercial Items (Oct 2000) applies to this acquisition. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. The provision at 52.212-3 Offeror Representations and Certifications – Commercial Items (June 2003) applies to this acquisition. The offeror must include a completed copy of this provision with their proposal. A copy of this clause can be found on http://www.arnet.gov/far. The provision at FAR 52.212-4 Contract Terms and Conditions – Commercial Items (Feb 2002) applies to this acquisition. The provision at 52.212-5 Contract Terms and Conditions Required to Implement Statutes or Executive Orders – Commercial Items (June 2003) applies to this acquisition. The contractor shall comply with the FAR clauses indicated herein that the Contracting Officer has indicated as being incorporated in this contract by reference to implement provisions of law or Executive orders applicable to acquisitions of commercial items: a) 52.203-6 Restriction on Subcontractor Sales to the Government (Jul 1995); b) 52.232-33 Payment by Electronic Funds Transfer – Central Contractor Registration (May 1999). The provision at DFAR 252.212-7001 Contract Terms and Conditions Required to Implement Statutes or Executive Orders Aplicable to Defense Acquisitions of Commercial Items (June 2003) applies to this acquisition. The provision at DFAR 252.225-7001 Buy American Act and Balance of Payments Program (Apr 2003) applies to this acquisition. The provision at DFAR 252.225-1101 Acquisition of Supplies applies to this acquisition. Award shall be made to the responsive, responsible offeror quoting the lowest overall evaluated price. Earliest delivery is the best. Quotations shall include the contractor’s cage code, Dun and Bradstreet Number (DUNN) and Tax Identification Number (TIN).
