NOTICE OF INTENT TO SOLE SOURCE - This is not a solicitation. This is a notice of intent to award a single source purchase order under NAICS code 324121. The Bureau of Land Management (BLM) in Moab, Utah will solicit and award a firm fixed price purchase order to Kilgore Companies, LLC to provide approximately 800 tons of hot-mix asphalt pavement surface course, F.O.B. at plant location (4910 Old Airport Rd, Moab, Utah). This action is the result of a cost sharing agreement between the BLM and San Juan County to pave Fire Center Drive, which provides access to the BLM's Moab Interagency Fire Center. San Juan County exercises administrative authority over the road and the County holds a current contract with Kilgore Companies, LLC for the supply of asphalt pavement for a large airport runway paving project that requires a preliminary control strip. Due to the existing contractual relationship with San Juan County, Kilgore Companies, LLC is the only responsible source that can provide the movement materials for this cost-sharing arrangement for pavement materials. The statutory authority for other than full and open competition is FAR 6.302-1, 10 USC 2304(c)(1), "only one source and no other supplies or services will satisfy agency requirement". A Justification for Other than Full and Open Competition has been prepared in support of this acquisition. A determination by the Government not to compete this requirement based on responses to this notice is solely within the discretion of the Government.
