The U.S. Department of State Office of Acquisition Management intends to issue a Sole Source Award to Colt Defense LLC, Hartford, CT for the acquisition of (15) M4A1 Machine Guns. Colt Manufacturing is the only legitimate source of the M4A1 Carbine as they are the exclusive owner of the M4A1 Carbine technical data package, which includes ownership of the design, patent and trademark rights. This requirement is needed to replace current unserviceable M4A1 weapons in the field. The M4A1 is the system that DS agents have been trained to use and the economic impact to the U.S. Government for using other items than what is requested would be great and involve the re-training of all agents in the field including purchasing all new weapons to issue to the various missions overseas. The statutory authority permitting other than full and open competition is 10 U.S.C. 253 (c)(1).
