This notice will be distributed solely through the General Services Administration's Federal Business Opportunities (FBO) Website (www.fedbizopps.gov). The FBI is responsible for processing known reference samples of Convicted Offenders, Arrestees and Detainees. The Federal DNA Database Unit became operational in December 2000 as the Federal Convicted Offender Program and collects and analyzes DNA samples submitted from around the country as required by the DNA Backlog Elimination Act of 2000, the USA Patriot Act of 2001, the DNA Fingerprint Act of 2005 and the Adam Walsh Child Protection and Safety Act of 2006, broadened the scope of sample collections from just convicted federal offenders to include federal arrestees, as well as non-U.S. citizen detainees. Under those acts, federal agencies, to include the FBI, are directed by the USAG to collect DNA samples from individuals who are arrested, facing charges, convicted, or from non-United States persons who are detained under the authority of the United States. In order to comply with this legislation and be able to process the exponential increase in samples being submitted to the FBI, the program requires a preventive maintenance agreement to ensure the successful operation and to maintain optimum performance of our optical character recognition software package known as TurboScan that is provided by HOV Services Inc. The TurboScan system is used to scan the FD-936 form submitted for DNA sample submissions uploaded to the National DNA Index (NDIS) and is considered a critical system for the FBI.
HOV Services Inc./Exela Technologies is the only provider of this service as they are the sole provider of the TurboScan software package. HOV Services Inc./Exela Technologies is the only company that will be able to modify the configurations as they are the only company that provides the TurboScan software. HOV Services is also the only provider that is able to respond on-site within a one hour notice.
Based on market research conducted and contacts made with knowledgeable individuals within the government and related industry, it has been determined the FBI's requirement can only be provided by HOV Services Inc./Exela Technologies, as no other vendor is capable of providing the TurboScan software that is needed for direct support of the FBI's mission and respond on-site within a one hour notice.
This notice of intent is not a request for competitive quotations; however, per FAR 5.207(16)(ii) all responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. All capability statements or quotes shall be submitted to the Contracting Officer Adelle Bolton by email. Telephone requests will not be considered. A determination by the Government not to compete this proposed contract based upon response to this notice is solely within the discretion of the Government.
All responses to this intent to sole source are due to the contracting officer by 10:00am EST on October 25, 2019 please.
Vendors must be registered in the System for Awards Management (SAM.gov) to receive government contracts. The FBI uses a financial system that has a direct interface with SAM. Please ensure that your company's SAM information is updated and accurate. This includes TIN, EFT, DUNS, addresses and contact information. The EFT banking information on file in SAM will be what the FBI uses to process payment.

By signing the contract or commitment document, the contractor agrees to this restriction with respect to all new employees utilized directly to perform duties on the contract. Non-U.S. citizens currently employees under this contract or commitment may continue performance unless otherwise directed by the Department of Justice. No new, replacement, or additional Non-U.S. citizens may be added to the contract without the express approval of the Department of Justice.
